These general terms and conditions of sale apply to all sales concluded on our website Labubu Accessories by us with consumers (“Client”).

On this site, the terms “seller,” “we,” “us,” and “our” refer to Labubu Accessories.

2 – SCOPE AND ACCEPTANCE

Labubu Accessories provides this website, including all information, tools, and services available from this site to you, the consumer, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

You may review the most current version of the Terms and Conditions of Sale and Use at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes on our website. It is your responsibility to check this page periodically for changes. Continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

The applicable Terms are those in effect on the date your order is placed on our website.

These Terms are intended to define the rights and obligations of both the Seller and the Client in the context of online sales on the Labubu Accessories website. The online sale concerns the following products: plush toys, accessories, decorations, and clothing.

3 – CONDITIONS FOR USING OUR ONLINE STORE

By accepting these Terms, you confirm that you are of the age of majority in your country, state, or province of residence, and you have given us your consent to allow any minor dependents to use this website.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Any breach or violation of these Terms will result in immediate termination of your Services.

4 – PRODUCTS

The products offered on our website are those listed on Labubu Accessories. The Client has access to full descriptions of all products (price, weight, size, color, and composition).

All products are available in limited quantities. Due to the nature of remote selling, the product(s) ordered may be out of stock at the time the order is confirmed. In such cases, the Client may choose a full refund within 14 days or a product exchange. If the Client chooses a refund, the full order amount including shipping will be refunded.

We reserve the right to limit the sales of our products or services to any person, region, or jurisdiction. We may exercise this right on a case-by-case basis. We also reserve the right to limit quantities of any product or service.

We reserve the right to update, improve, or remove any product from our website at any time. Product descriptions and prices are subject to change without notice at our sole discretion. Any offer for any product or service made on this site is void where prohibited.

We do not guarantee that the quality of any products, services, or other material you purchase will meet your expectations, or that any errors will be corrected.

We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee your monitor’s display will be accurate due to different screen settings. Product photos are not contractual, and all products are sold without jewelry unless clearly stated on the product page.

5 – ORDER

To finalize an order, the Client must accept our Terms and be aware of the delivery times and shipping methods offered.

By checking the box to accept our Terms, the Client enters into a sales contract with us, which constitutes full acceptance without restriction.

Steps to conclude the contract electronically:

  • Create a Client account;
  • Select products and add to cart;
  • Validate the order;
  • Log into your account;
  • Review the order and correct any errors if needed;
  • Confirm the order;
  • Accept the Terms;
  • Pay for the order.

The Client can verify the details and total price before final confirmation. We will confirm the order by email to the address provided by the Client. Once confirmed, the order cannot be modified or cancelled.

We reserve the right to block or refuse any excessive order or order with incorrect address information.

6 – PRICES AND PAYMENT

Prices may change without notice. We are not liable to you or any third party for price changes, suspensions, or discontinuation of the Service. We will apply the price in effect at the time the order is placed.

All prices are in euros, including VAT. Additional shipping costs are calculated at checkout before final confirmation.

For international orders, local taxes or customs duties may apply. The Client is responsible for these fees. Products remain our property until full payment is received.

By placing an order, the Client agrees to pay the full amount immediately. Payments are made via credit card.

In the event of payment issues or failure to comply with these conditions, we may suspend or cancel delivery. No amount can be withheld or offset due to a claim.

7 – DELIVERY

Clients can choose between two delivery options at checkout:

  1. Standard Delivery: 6–10 business days from shipment
  2. Secure Delivery: 6–10 business days from shipment

Unless otherwise stated (e.g. for holiday closures), orders are processed within 24–48 hours, with delivery times of 6–10 business days to mainland France, Belgium, Switzerland, and eligible European countries. Delivery to overseas territories or international destinations may take up to 30 days.

Delivery restrictions are clearly indicated at the start of the order process. Clients should check their country’s regulations before ordering.

Delivery is made to the address provided by the Client. Risk passes to the Client upon physical possession of the goods.

In the event of unavailability or delivery failure, the Client may request a refund. However, we do not issue refunds for delayed deliveries.

Clients must inspect packages upon receipt and refuse delivery if damaged. Claims must be made in writing within 3 days.

In case of delay exceeding 16 business days from the maximum delivery date (except in cases of force majeure), contact us at contact@labubu-accessories.com. If the product is in transit, it must be received before any return or refund request.

During the Christmas season, we only guarantee delivery for orders placed before December 4th of the current year.

8 – WITHDRAWAL AND REFUND

Under consumer law, Clients have 14 days to withdraw without giving a reason, starting from the day they receive the item. For multiple items delivered separately, the period begins upon receipt of the last item.

To withdraw, notify us at contact@labubu-accessories.com before the 14-day period ends.

Clients then have 14 days to return the item(s) to the address provided by email. Items must be unused and in original packaging. Personalized orders are not eligible for refunds, only exchanges if defective. Return shipping costs are borne by the Client.

Once received and inspected, we will refund the full order amount, including shipping, within 14 days using the original payment method.

Return conditions:

  • Return costs are your responsibility.
  • Requests must be made within 14 days of delivery.
  • All items must be returned in original condition.
  • Damaged items will not be refunded.
  • We may refuse returns that do not meet these conditions.
  • We are not responsible for delivery errors made by the Client.

9 – LEGAL WARRANTY OF CONFORMITY

A product is compliant if it serves its expected purpose and matches its description. In case of non-compliance, the Client may request repair or replacement. If costs are disproportionate, we may refuse.

If repair or replacement is not possible, the Client may return the product for a full refund or keep it and receive partial compensation.

Clients have 12 months from delivery to make a claim. Defects appearing within 12 months are presumed to have existed at the time of delivery.

10 – LEGAL WARRANTY AGAINST HIDDEN DEFECTS

The Client must prove that hidden defects existed at the time of sale and rendered the product unusable. The Client may request a replacement, full refund, or partial refund while keeping the item.

12 – INTELLECTUAL PROPERTY

All content on the Labubu Accessories website is the property of the Seller.

Labubu Accessories holds the intellectual property rights or usage rights for all elements on the site, including text, images, logos, and graphics.

Any unauthorized reproduction is prohibited and will be considered infringement and prosecuted.

13 – PERSONAL DATA

Your personal data is used to process your order and manage customer relations. It may be shared with third parties (e.g. delivery services).

We comply with data privacy laws and process your data accordingly. Clients may access, modify, or delete their data by emailing contact@labubu-accessories.com.

We collect your data for the following purposes:

  • Order management (contracts, billing, delivery, accounting, loyalty programs, satisfaction surveys, after-sales, etc.);
  • Managing disputes and unpaid invoices;
  • Collecting reviews and feedback;
  • Statistical analysis;
  • Updating marketing databases per national regulations;
  • Promotions, contests, and giveaways;
  • Processing rights requests (access, correction, opposition);

Data is kept only as long as necessary for commercial purposes or legal obligations. No personal information is shared, sold, or transferred without consent. In the event Labubu Accessories is sold, data may be transferred to the new owner under the same confidentiality obligations.

14 – SEVERABILITY

If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall still be enforceable to the fullest extent permitted by law. The rest of the Terms shall remain valid and enforceable.

15 – LANGUAGE AND GOVERNING LAW

These Terms are written in French. In the event of a dispute regarding interpretation or enforcement, the Client should first contact the Seller for an amicable resolution.

If any provision is ruled invalid by a court, it will not affect the remaining provisions. Clause headings are for reference only; the actual clause text prevails.

16 – NO WAIVER

Failure by either party to enforce any provision of these Terms shall not be interpreted as a waiver of that provision.
